Showbound Innovations LLC – Terms and Conditions

 

1. Property Readiness

 

• The Client is expected to have the property "camera ready" prior to the scheduled appointment. This includes cleaning, furniture staging, and ensuring all areas to be photographed or filmed are prepared.

• Clients should review our Getting Ready Checklist to ensure the best possible results.

• If the Photographer/Videographer arrives and the home is not ready, the property will be shot "As Is."

• If you would like to provide input on specific shots or angles, please meet the Photographer/Videographer at the beginning of the appointment or leave notes in the "Comments" section of your order.

• Absent specific input, our team will use their professional judgment to highlight the property in the best way possible.

 

2. Order Details & Accuracy

• Clients are responsible for accurately entering all order details, including property size and service requests.

• If incorrect information is provided (e.g., incorrect square footage), we reserve the right to update the order and adjust pricing accordingly, where square footage is applicable.

• Our pricing is based on a single residential dwelling. For commercial or multi-unit properties, please contact us for a custom quote.

 

3. Reschedule/Cancellation Policy

• Appointments canceled or rescheduled within 24 hours of the appointment start time will be subject to a $50 cancellation fee.

• If weather conditions prevent us from completing a shoot (e.g., unsafe drone flying conditions, heavy rain preventing exterior shots), we will contact the Client to reschedule, and the cancellation fee will be waived.

 

4. Payment Terms

• Payment is required before downloading any media for most orders.

• Brokerages and or similar entities may setup NET 15 terms with a Purchase Order

• For NET 15 terms, a $25 late fee will be applied to any balance unpaid after 15 days.

• For NET 15 terms, if an account balance remains unpaid for 45 days, we will pause any new orders and freeze access to existing media until payment is received.

• For NET 15 terms, if an account remains unpaid for 90 days, it will be sent to collections.

 

5. Delivery & Storage

• Media will be delivered via the online portal after payment is completed.

• Showbound Innovations LLC does not guarantee indefinite media storage. Clients are responsible for downloading and storing their files.

• Matterport 3D Tour links will be deleted approximately 1 to 2 weeks after the property has been sold.

• For 3D Matterport tours that wish to keep their tour active (typically industrial or theme parks as an example) a $39/month storage fee will be implemented. 

 

6. Service Area & Travel Fees. 

 

Travel fees apply as follows:

Primary service area is Kimberling City and 35 miles radius:

• 0 - 35 miles: No additional charge

• 36.1 - 50  miles: $25

• 50.1 - 60 miles: $50

• 60.1 - 75 miles: &75

• Properties beyond 75 miles will be reviewed. Contact management for options.

Second Business Day (Before 5 PM or sooner):

• Drone Video

• Walkthrough Video

• Matterport 3D Tour

• 3D Floor Plans

• Any additional Specialised Editing Not Covered by Terms

 

8. Rights and Usage 

 

Grant of Rights

• Showbound Innovations LLC retains full copyright ownership of all media, including photography, videography, drone footage, and 3D content.

• We reserve the right to use any media for portfolio purposes, advertising, promotional content, or industry competitions.

Usage Rights

• The Client is granted a limited, non-transferable license to use the media only for listing and marketing purposes related to the specific property.

• If the Client wishes to use the media beyond listing purposes (e.g., for branding, advertisements, or additional marketing), written consent may be granted by contacting Showbound Innovations LLC.

• The license expires when the listing agreement for the property ends or the property is sold.

• Media may not be sold, transferred, or licensed to third parties without prior written consent from Showbound Innovations LLC.

 

9. Releases & Liability

• The Client represents that they have obtained all necessary permissions from the property owner for photography, videography, and drone services.

• The Client agrees to indemnify and hold harmless Showbound Innovations LLC from any claims arising from the use of media, including privacy concerns or disputes regarding property rights.

• Showbound Innovations LLC follows FAA regulations for drone operations. If drone footage cannot be captured due to legal or weather restrictions, it will not be included in the final media.

 

10. Modifications

• Showbound Innovations LLC reserves the right to modify these Terms and Conditions at any time. Continued use of our services constitutes acceptance of any updates.

 

Texting Privacy Policy

Showbound Innovations LLC uses SMS messaging to communicate with clients about real estate photography services, including scheduling, inquiries, and service updates.

By texting us, you consent to receive text messages from us.

• Message frequency varies. You may expect one or two SMS messages within a week during coordination of your photo shoot. However, texting is solely based on information needed from you the agent.

• Message and data rates may apply.

• You can text HELP at any time for more information.

• To stop receiving messages, reply STOP. You will receive a confirmation message and will not receive further SMS communications.

We do not sell, rent, or share your phone number or message content with third parties.

Security Practices

Showbound Innovations LLC takes privacy seriously. To protect user data collected through SMS communications, we implement the following measures:

• Encryption: All messages are transmitted over secure channels.

• Access Controls: Only authorized personnel have access to SMS communication data.

• Regular Audits: We periodically review and update our privacy and security practices to ensure compliance with industry standards.

• No Unauthorized Sharing: We do not share or sell SMS data with third parties.
